Lark Hall is located at 351 Hudson Avenue, Albany, New York.  Lark Hall is comprised of (i) an approximately 3,500 square foot main floor, bar, stage, and bathrooms amenities (the “Main Hall”), (ii) an approximately 550 square foot, semi-private mezzanine area (the “Mezzanine”), and (iii) an approximately 1,200 square foot private green room with living room spaces, private kitchen, bathroom and dressing rooms accessible from both the Main Hall and Mezzanine (the “Green Room”).

Rental Period and Event Hours:

Lark Hall, aka “The Venue”, is available for rent based on a standard eight (8) hours use of the facility for a five (5) hour event. This time period includes up to two (2) hours for setup, five (5) hours for the actual event and one (1) hour for cleanup.  The actual event must end no later than allowable hours of operation as indicated herein.  Additional event hours can be secured at the rate of two hundred fifty dollars ($250.00) per hour.  Receptions cannot be longer than six (6) hours.

ADDITIONAL TIME FOR SETUP, ROOM DECORATING, VENDORS, ETC.   If the Renter or invited and approved vendors need additional time for set up, room decorating, etc., the Renter may ask for access to the Venue beyond the contracted nine (8) hours for an additional charge.   Additional setup hours must be contiguous with event hours (additional set-up or breakdown time is only available for the hours immediately before or after the event and at Owner’s discretion).  Renter must request this time in writing at least thirty (30) days prior to the event. Additional set-up and breakdown time will be billed at the rate of one hundred dollars ($100.00) per hour or portion thereof.

Rental Includes an onsite Event Coordinator and Bar Staff for the maximum period of use of the Venue as set forth herein at the rates indicated.  Additional set up and event time is available at an additional charge. Up to 12 assorted tables and 50 banquet chairs included, with additional tables and chairs available upon advance reservation and additional cost.  The event coordinator does not decorate.

ADVANCE SECURITY DEPOSIT REQUIRED

A minimum $750 security deposit is required to reserve a date, with 100% of the total estimated rental fees payable due no later than sixty (60) days prior to the reserved event (including bar package, known extras and tax). The security deposit will be returned within thirty (30) days after the event or when all accounts are settled, whichever is later, if there has been no infraction of this Agreement by Renter, its agents, vendors or representatives.  Any cancellation of the event less than thirty (30) days prior to the event will result in the forfeiture of the security deposit.  All cancellations are subject to forfeiture of the security deposit as liquidated damages if the Venue has booked additional amenities and/or production staff for the event.  If you fail to meet the bar minimum set for your event, the remaining difference will be subtracted from the security deposit. Security deposit and all other invoices must be paid by credit card, cash or money order ONLY.  We require a credit card for any incidentals the day of the event.

Any cancellation under thirty (30) days prior to an event shall result in a total retainer of all fees due and paid to date to Owner as liquidated damages. Owner reserves the right to cancel any event for which payment outlined above is not received by designated date.  If a cancellation occurs due to failure to pay the event fee by the time required, any payment made toward billing for the event in less the full amount will be forfeited as liquidated damages. Said partial payment is in addition to the security deposit, which shall also be retained as per that provision of this contract. 

Venue Rules:

Renter agrees to comply with all applicable laws and regulations in connection with use of the Venue.  There is absolutely NO SMOKING OR VAPING on premises.  At no time is Renter allowed on a ladder. Owner must supervise and complete all decorating work on a ladder. If you need ladder work, Renter must notify Owner in writing 2 weeks before your event.  Rental rates are for private parties only. The use of raw rice, confetti, glitter, smoke and bubble machines is prohibited, and any such use will result in a forfeiture of the security deposit. You may not put holes in any walls. Youth functions (under age 21) are required to have one adult chaperone (over age 21) per 10 minors. Alcoholic beverages will not be served at youth functions.  All items brought into the Venue (e.g., personal items, decorations, props, etc.) must be removed immediately following the event. Items that are not removed will be disposed of by Owner and the cost of such disposal will be deducted from the security deposit. 

Renter Indemnification and Insurance Requirements

The Renter hereby releases the Owner from, and agrees that the Owner shall not be liable for, and agrees to indemnify, defend and hold the Owner and its officers, members, directors and employees, and their respective successors, assigns or personal representatives, harmless from and against any and all (i) liability for loss or damage to property or injury to or death of any and all persons that may be occasioned by any cause whatsoever pertaining to the Renter’s event at the Venue or arising by reason of or in connection with the occupation or the use thereof or the presence on, in or about the Venue or (ii) liability arising from or expense incurred by the Owner’s leasing of the Venue to the Renter, including without limiting the generality of the foregoing, all causes of action and reasonable attorneys’ fees and any other expenses incurred in defending any suits or actions which may arise as a result of any of the foregoing.  The foregoing indemnities shall apply notwithstanding the fault or negligence on the part of the Owner, or any of its respective members, officers, agents  or employees and irrespective of the breach of a statutory obligation or the application of any rule of comparative or apportioned liability; except, however, that such indemnities will not be applicable with respect to willful misconduct or gross negligence on the part of the Owner to the extent that such an indemnity would be prohibited by law. 

All Renters must provide proof of currently bound liability insurance. All Renter corporations, LLCs or other duly established business and/or not-for-profit entities shall provide proof of insurance against loss or losses from liabilities imposed by law or assumed in any written contract (including the contractual liability assumed herein) and arising from personal injury and death or damage to the property of others caused by any accident or occurrence, with limits of not less than $1,000,000 per accident or occurrence on account of personal injury, including death resulting therefrom, and $1,000,000 per accident or occurrence on account of damage to the property of others, excluding liability imposed upon the Renter by any applicable workers’ compensation law; and a blanket excess liability policy protecting the Renter against any loss or liability or damage for personal injury or property damage.

Prior to the date of the event, Renter shall provide proof of the aforesaid coverage and provide the Owner with a binder naming the Owner as an additional insured and certificate holder.  All insurance shall be procured and maintained in financially sound and generally recognized responsible insurance companies 

This Agreement shall be governed, construed and enforced in accordance with the laws of the State of New York for contracts to be wholly performed therein.

Renter has read and agrees to all terms and conditions set forth within this Agreement and agrees to be bound by its terms.
